Section 504 Notification Letter to Parents |

Section 504 is to protect the civil rights of persons with a disability. The statue in Section 706(8) provides:
No otherwise qualified individual with a disability in the United States shall by reason of his/her disability be excluded from the participation in, be denied the benefits of or be subjected to discrimination under any program or activity receiving Federal financial assistance.
The major responsibility of 504 is in regular education. For a claim to be made under Section 504, an individual must meet certain statutory definition:
1. The individual must have a documented physical or mental impairment.
2. The impairment must substantially limn one or more of the individual’s major life activities. Major life activities include walking, seeing, hearing, speaking, breathing, learning, working, caring for one's self, and performing tasks.
3. The individual must have a record of an impairment or regarded as having such an impairment.
There is no specific list of diseases or conditions that qualify as physical or mental impairments. Some examples of potential 504 protection not typically covered under IDEA include medical condition such as communicable diseases, H IV, tuberculosis, asthma, allergies, diabetes, heart disease, Attention Deficit Disorder (ADD), drug/alcohol addiction, and Pervasive Developmental Disorder. However, having an impairment qualifies an individual for Section 504 provision only if that impairment substantially limits one or more major life activity such as learning. A contagious ear condition or ADD are examples that are only protected if the condition substantially limits a major life activity. Some conditions are not covered by 504 such as any person currently using drugs and is not an "individual with a disability." However, an individual who has completed or is enrolled in drug rehabilitation program falls under the Section 504 protection.
Section 504 requires a written educational accommodation plan. It is recommended that a group of persons knowledgeable about the student should be part of the group developing a 504 Plan. There is a requirement for parental notification, but not consent.
Our School district currently has a 504 Delivery Plan form, a parents' guide to Section 504, modification and accommodation checklists and a Section 504 Policy (JBA).
I have included appropriate forms and guidelines. Your district 504 Coordinator is Dr. Liz Jurgensen. The 504 Building contact person is the elementary principals and the counselors at the Middle School and the High School.
All 504 Plans should be sent to Dr. Liz Jurgensen in the Special Education Office. This office will coordinate transfer of the 504 Plans between schools. |
